The best-interests standard is a widely used ethical, legal, and social basis for policy and decision-making involving children and other incompetent persons. It is under attack, however, as self-defeating, individualistic, unknowable, vague, dangerous, and open to abuse. The author defends this standard by identifying its employment, first, as a threshold for intervention and judgment (as in child abuse and neglect rulings), second, as an ideal to establish policies or prima facie duties, and, third, as a standard of reasonableness. Criticisms of (...) the best-interests standard are reconsidered after clarifying these different meanings. (shrink)

definitions and explanations frequently come together and permeate almost all fields of knowledge. This does not exclude mathematics, even when these definitions hold clear links and close connections with our physical world. Here we propose a rather different perspective. Making operational physical assumptions, we show how it is possible to rigorously reconstruct some features of both geometry and topology. Broadly speaking, assuming this operational and more concrete philosophy we not only are capable of defining primitive concepts like points, straight lines, (...) planes, angles and spaces, but we also go all the way up to more complex constructions. We show that within our method it is also possible to come up with what we call a compass-based topology as well as a normed and a metric space. We hope this operationalist point-of-view can assist other researchers and students to have a clearer understanding of these quite abstract concepts. (shrink)

Su objetivo es crear un instrumento para evaluar la riqueza creativa en diseño mecánico, con un método exploratorio y propositivo de validación de instrumentos y pruebas piloto sobre 156 estudiantes. Resultaron de imaginar objetos diversos, compatibles con una vista dada, y definir cinco niveles de riqueza según la canti- dad, diversidad y calidad de respuestas comparadas contra un patrón de soluciones creado por expertos. _The purpose_ of this article is to explain in religious, secular, and post-secular contexts the functional potential of conceptualizing the miracle as a text or message with a motivational effect. _Theoretical basis._ Max Weber, Ernst Tugendhat, Alexander Geppert and Till Kössler analysed the processes of enchantment and disenchantment of the world on a philosophical basis. The representatives of the Frankfurt school (Theodor Adorno, Max Horkheimer, Walter Benjamin) and their followers describe the cultural processes of post-secularism (Jürgen Habermas, Peter Sloterdijk) in (...) detail. The logic of cultural and social representation of amazing events and their descriptions can be realized by combining hermeneutic analysis with a functionalist approach based on the model of Niklas Luhmann and the discursive ethics of Karl-Otto Apel. _Originality._ Desired cultural, social and political situations in society often arise unexpectedly and suddenly, which provokes to characterize them as a miracle. However, at the basis of the emergence of such situations are the rules of social communication, in particular those that provide for asymmetric communication with questions that await answers. A miracle appears at the moment of transformation of asymmetric communication into a symmetrical one: each specific miracle-phenomenon needs its own metaphorical understanding and interpretation as a message. _Conclusions._ The article proposes an analysis of miracle phenomenon in its cosmological, anthropological and educational implications. Some tendencies fixed by communicative turn of the contemporary philosophy are also contributed to considering the miracle in its objective and subjective representations. The semantics of the miracle is analysed according to the relevant problem fields. The functionality of miracle is examined on its ability to show orientation for the contemporary societies with their tendency to post-secularity. The fusion of Pre-modernity and Late Modernity is taking into account when the semantics of miracle is described accordingly to their communication functionality. The enchanting and disenchanting dialectic is explained on semantics of miracle as a world and cosmic events. (shrink)

8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Bioethics is best viewed as both a second-order discipline and also part of public discourse. Since their goals differ, some bioethical activities are more usefully viewed as advancing public discourse than academic disciplines. For example, the “Universal Declaration on Bioethics and Human Rights” sponsored by the United Nations Educational, Scientific, and Cultural Organization seeks to promote ethical guidance on bioethical issues. From the vantage of philosophical ethics, it fails to rank or specify its stated principles, justify controversial principles, clarify key (...) terms, or say what is meant by calling potentially conflicting norms “foundational.” From the vantage of improving the public discourse about bioethical problems and seeking ethical solutions in the public arena, however, this document may have an important role. The goals and relations between bioethics as a second-order discipline and public discourse are explored. (shrink)

Hume’s critique of traditional abstraction entails a result that undercuts his account of the idea of identity. To save his account of identity, Hume would have to accept abstraction as well. What links these two discussions is (1) Hume’s widely shared assumption that traditional abstraction is separating in the mind what are inseparable in reality, (2) his principle that what are different are mentally separable, and (3) his principle that we cannot conceive of the impossible. Given these, it will turn (...) out that abstraction is mentally separating something from itself, which will entail that abstraction is conceiving of something as distinct from itself. But it is impossible for something to be distinct from itself, and so it is inconceivable. Therefore abstraction is impossible. Yet consider Hume’s account of the idea of identity. On that account, to conceive of an identity is to conceive of something as one single thing viewed one way and as two distinct things viewed another. How we can take these opposing views of the same thing is a problem that I’ve termed Hume’s Difficulty concerning Identity. It will turn out that we can take the opposing views only if we can conceive of the single thing viewed one way as somehow distinct from itself when viewed the other way. That is, we must be able to conceive of something as distinct from itself. However, if we cannot conceive of something as distinct from itself when abstracting, then we cannot do it when conceiving of an identity. So traditional abstraction and Hume’s account of the idea of identity stand or fall together. (shrink)

Recalcitrant disputes among health care providers and patients or their families may signal deep cultural differences about what interventions are needed or about clinicians’s professional duties. These issues arose in relation to a mother’s request for hymenoplasty or revirgination for her minor daughter to enable an overseas, forced marriage and protect her from an honor killing. The American College of Obstetrics and Gynecology committee recommends against members performing a hymenoplasty or other female genital cosmetic surgeries due to a lack of (...) data concerning their safety and efficacy. A key issue in such cases is how to determine what is in the minor’s best interest and the scope of health care moral or professional’s duties. The Best Interests Standard can serve as a powerful moral tool for resolving cross-cultural disputes and identifying needed policy. (shrink)

In this paper we focus on the modularity of visual functions in the human visual cortex, that is, the specific problems that the visual system must solve in order to achieve recognition of objects and visual space. The computational theory of early visual functions is briefly reviewed and is then used as a basis for suggesting computational constraints on the higher-level visual computations. The remainder of the paper presents neurological evidence for the existence of two visual systems in man, one (...) specialized for spatial vision and the other for object vision. We show further clinical evidence for the computational hypothesis that these two systems consist of several visual modules, some of which can be isolated on the basis of specific visual deficts which occur after lesions to selected areas in the visually responsive brain. We will provide examples of visual modules which solve information processing tasks that are mediated by specific anatomic areas. We will show that the clinical data from behavioral studies of monkeys (Ungerleider and Mishkin 1984) supports the distinction between two visual systems in monkeys, the 'what' system, involved in object vision, and the 'where' system, involved in spatial vision. There is a popular hypothesis that performance on implicit and explicit memory tasks reflects 2 distinct memory systems. Explicit memory is said to store those experiences that can be consciously recollected, and implicit memory is said to store experiences and affect subsequent behavior but to be unavailable to conscious awareness. Although this division based on awareness is a useful taxonomy for memory tasks, the authors review the evidence that the unconscious character of implicit memory does not necessitate that it be (...) treated as a separate system of human memory. They also argue that some implicit and explicit memory tasks share the same memory representations and that the important distinction is whether the task (implicit or explicit) requires the formation of a new association. The authors review and critique dissociations from the behavioral, amnesia, and neuroimaging literatures that have been advanced in support of separate explicit and implicit memory systems by highlighting contradictory evidence and by illustrating how the data can be accounted for using a simple computational memory model that assumes the same memory representation for those disparate tasks. In this aricle, I argue that Descartes can be seen as a occupying a distinct middle ground between ancient music theory, which was being revived in the Renaissance, and eighteenth-century aestheticians. Descartes’ approach to music had its roots in humanist thought but, even from the start, it wasn’t simply another humanist theory of music. The views Descartes begins to develop in his early years, in the Compendium musicae (1618), is continuous with the views he articulates near the end of his (...) life in the Passions of the Soul (1649). And the position on the effects of music is an interesting and important one, bridging humanist thought with the new philosophy. Unlike the humanists, Descartes will be unwilling to identify particular musical proportions as intrinsically connected with pleasure or other affects, but he will nevertheless develop an objective account of aesthetic value. Here, we report on a quasi-experimental study to explore the applicability and perceived benefits of the CRAFT program, which is based on mindfulness, yoga, positive psychology, and emotional intelligence, to improve higher education student musicians’ health and well-being during the lockdown. A subset of student musicians at a Higher Conservatory of Music in Spain followed the CRAFT program during the academic year 2019/2020, 1 h per week as part of their curriculum. Students enrolled in CRAFT-based elective subjects formed the CRAFT (...) program group, while other students represented the control group. The onset of the national lockdown elicited by the COVID-19 pandemic occurred halfway through the program, which was subsequently delivered in an online format. We administered an online survey to explore the effect that the exposure to the CRAFT program had in terms of how participants dealt with various health and well-being concerns arising from the COVID-19 lockdown. There was a significantly higher proportion of proactive participants in the CRAFT program group, 92%, than in the control group, 58%, in terms of implementing practices to improve their health and well-being during the lockdown. Additionally, significantly more participants acknowledged perceived benefits from their practices in the CRAFT program group, 78%, than in the control group, 52%. Among proactive participants, yoga/meditation was the most implemented in the CRAFT program group, followed by exercise, and other yoga/meditation practices, whereas in the control group, exercise and Alexander technique-based practices were the most applied. In the CRAFT program group, the highest rate of perceived benefits was from yoga/meditation CRAFT-based practices, 51%, followed by exercise, 32%, and other yoga/meditation practices, 27%, whereas in the control group, benefits were reported by 29% of exercising participants and 16% for those having practiced the Alexander technique. A similar pattern was observed when excluding participants with previous yoga/meditation experience. This study revealed how participants can independently apply learned skills from the CRAFT program in response to a naturally occurring life event of unprecedented global impact, suggesting that previous exposure to mindfulness and yoga is likely to have a beneficial effect on how young adults react towards exceptionally stressful conditions. Suppose there are different standards for counting the same things. Then what are two distinct things counting strictly may be one and the same thing counting loosely. Within a given standard identity is one-one. But across standards it is many-one. An alternative interpretation using the parts-whole relation fails, because that relation should be understood as many-one identity. Quantum electrodynamics is the theory of electrons and other elementary charged particles, interacting through the exchange of light quanta. Albert Einstein introduced the light quantum in 1905, but for about three decades physicists applied quantum ideas mainly in theories of the structure and behavior of matter, not to electromagnetic radiation itself, which was always treated semi-classically. This began to change after 1923 with the discovery of the Compton effect and its kinematic description by Arthur Compton and Peter Debye, based on (...) the light quantum. In this paper we review the study of high-energy radiation that led to Compton's discovery. We discuss the analysis of the intensity distribution of Compton-scattered radiation that together with the ''new'' quantum theory beginning in 1925, resulted in the development, especially by Pascual Jordan and Paul Dirac, of a quantum theory of electromagnetic radiation in interaction with matter. Mishel Fuco not only influenced the consciousness of modern West, but changed the modus of thinking, the way of perception of many traditional notions, transformed the opinions about the reality, history, person. Philosopher’s principle research programme which attaches the entirety to his works is “archeology of knowledge” programme, the search of human knowledge’s original layers. Let us mark that all Fuco’s works in 1960s are devoted to main aim: to clear up the conditions of historical origin of different mental aims (...) and social institutions in the culture of the Modern Time. Though in the whole this common aim remained for Fuco invariable, but the level on which he realizes his research search is changing constantly and rather logically. Relations of power, and to be more exact,accumulations of power and knowledge, social and cognitive which define all the aggregate of specific possibilities of culture in each given historical period. More than that the philosopher offers the particular prospects of sight of modern society and precisely totality of power relations, its ubiquitous nature and specific productivity which produces itself in each moment in any point or rather in any attitude from one point to another. From Fuco’s point of view the power is everywhere and not because it involves everything but because it comes from everywhere. The power is productive in that degree in which it is not associated with one definite imperious instance but pierces all kinds of activity in society, putting on its indelible stamp, developing under definite angle and due to this factit causes products, produced by them. The power induces and at the same time determines the fact which appears as a result of its inducement. The thirst of supremacy, which surrounds the individual and is focused on it as on the center of its use of force, comes out as a defining sign. It should be noticed that Fuco’s conception of power is not reduced to the understanding it as anonymous impersonal net of relations, piercing all society. Background: The search for genetic variants between racial/ethnic groups to explain differential disease susceptibility and drug response has provoked sharp criticisms, challenging the appropriateness of using race/ethnicity as a variable in genetics research, because such categories are social constructs and not biological classifications.Objectives: To gain insight into how a group of genetic scientists conceptualise and use racial/ethnic variables in their work and their strategies for managing the ethical issues and consequences of this practice.Methods: In-depth semi-structured interviews were conducted with a (...) purposive sample of 30 genetic researchers who use racial/ethnic variables in their research. Standard qualitative methods of content analysis were used.Results: Most of the genetic researchers viewed racial/ethnic variables as arbitrary and very poorly defined, and in turn as scientifically inadequate. However, most defended their use, describing them as useful proxy variables on a road to “imminent medical progress”. None had developed overt strategies for addressing these inadequacies, with many instead asserting that science will inevitably correct itself and saying that meanwhile researchers should “be careful” in the language chosen for reporting findings.Conclusions: While the legitimacy and consequences of using racial/ethnic variables in genetics research has been widely criticised, ethical oversight is left to genetic researchers themselves. Given the general vagueness and imprecision we found amongst these researchers regarding their use of these variables, they do not seem well equipped for such an undertaking. It would seem imperative that research ethicist move forward to develop specific policies and practices to assure the scientific integrity of genetic research on biological differences between population groups. Two things become one thing, something having parts, and something becoming something else, are cases of many things being identical with one thing. This apparent contradiction introduces others concerning transitivity of identity, discernibility of identicals, existence, and vague existence. I resolve the contradictions with a theory that identity, number, and existence are relative to standards for counting. What are many on some standard are one and the same on another. The theory gives an account of the discernibility of identicals using (...) phrases like “insofar as”. And it holds that standards for counting remain or shift depending on our purposes. (shrink)
